incident (point of law vs. procedure, Navarre, but incident d'instance as per art. 164 of the French Civil Code clearlys covers procedural points e.g. for joinder or dis-joinder of actions) is not an 'incidental plea', as in a ProZ answer, is rather an interlocutory or interim (AmE: collateral) motion or application that holds up a civil trial until resolved by being adjudicated upon.

Also 'question or particular point (arising in the course of proceedings), interlocutory procedure, & régulariser - cure a (procedural) defect, both FHS Bridge.
