Hello! I'm translating a lease agreement for a rental property in Quintana Roo, Mexico. I encountered the following phrase in the representations section:

[El arrendatario representa] "Que, con anterioridad a la firma del presente contrato, ha sido instruido sobre la situación, uso y régimen condominal a que se encuentra sujeto “EL INMUEBLE” objeto del presente acto, declara además que se somete a las obligaciones que le correspondan de conformidad con las cláusulas de este contrato y al régimen condominal donde se encuentra “EL INMUEBLE”.

I'm wondering if there is a convenient English equivalent for the phrase "situación, uso y régimen condominal." Thank you for your time!

@PG Yoi'd be amazed how many people don't know their @rse from their elbow! but agree with AMM that the phrase is ambiguous. It doesn't necessarily refer to ' status' though, and I doubt whether ' commonhold' would be the mot juste here. 'Location' might mean that there are several condominium sites in question, and not sure that 'condominial' works well as an adjective, and for that matter ' communal' either, although condos could be said to be in communal ownershi, but referring only to a select community of owners.

@ Phil I think you're saying that "condominal" is the adjective relating to all 3 of the words. That is definitely possible, but I definitely do not think they all have the same meaning.

I think situación, uso and régimen all mean the same thing, and "ha sido instruido sobre la situación, uso y régimen condominal a que se encuentra sujeto “EL INMUEBLE” basically means "has been informed of the nature of the condominium regime to which the property is subject".

I don't believe that "situación" means "location" as Andrew and Allegro have suggested. I think it goes without saying that the buyer knows where the property is.

I'm not quite sure why the first discussion entry is commenting on the answers in breach of the ProZ Site Rule 3.4.

Anyway, the ST /source text phrase is ambiguous and might better read: situación, uso y régimen condominal*es* to refer to all of the preceding words. (Zes, condominial is an adjective, though communal as joint ownership may work better).

BTW, user in Anglo-Am. law means not only the usage but alos the right of use.

Permitted use clauses (sometimes called *user* clauses) in leases often make reference to the classes of use in the Use Classes Order.

situation/status, use and condominium/condominial regime/regulations

In this case "situación" doesn't refer only to location (ubicación, localización) but also to the physical condition and market value, (which can lead to legal status, if it has a mortgage or is fully paid, and if it has its deed documents). So situation is alright, maybe status as legal status. Condominium/condominial/communal regime/regulations/regulation as body of rules applying to horizontal or vertical condominiums in the state of Quintana Roo.
