Odnosząc się do zarzutu naruszenia prawa procesowego, a w szczególności art. 224 § 1 k.p.c. wskazać należy, że odmowa uwzględnienia wniosku dowodowego zgłoszonego przez stronę (uczestnika postępowania) podlega ocenie na kanwie przepisów normujących zasady postępowania dowodowego, wobec czego nie może być traktowana jako samoistna postać naruszenia w/w przepisu (por. postanowienie S.N. z dnia 14 marca 2001 r. w sprawie II CKN 429/00, publik.
