Italian term

libero convincimento (del giudice)

Italian to English Law/Patents Law (general)
"Secondo l'orientamento consolidato della giurisprudenza il proncipio del libero convincimento implica che nel nostro ordinamento non esiste una gerarchia di efficacia delle prove."

According to De Franchi's Law Dictionary the French "intime convinction" is used in English.

On the Internet I found it translated as "inner conviction". Would that be actually used?

Thanks, V.

(judge's) freely exercised discretion

Maybe the judge's 'conviction' would be viewed a different way in Anglo-Am law, namely the judge exercises discretion over what items of evidence carry weight and which don't.

Example sentence:

Under the doctrine of the separation of powers, the ability of judges to exercise discretion is an aspect of judicial independence.
