Does anyone know a common translation for this? I checked the ProZ glossaries and couldn't find this. Sorry if I missed anything.

Grundsätze der Equity [englische Rechtsfortbildung und Billigkeitsrecht]
Equity bedeutet sehr vieles. Equity beinhaltet zum einen eine ganze Reihe von Rechtsinstituten, die entwickelt wurden, um das Common Law case law weniger rigide und flexibler zu gestalten und so mehr Gerechtigkeit zu schaffen (im 17. Jh. oder so). Zum Beispiel sind ganz normale deutsche Rechtsinstitute wie z.B. ein Nachbesserungsanspruch im Kauf- oder Werkvertragsrecht (specific performance) auf Equity gestützt. Zum anderen muss man mit seinen equitablen Ansprüchen vor die equitable jurisdiction, d.h. es beinhaltet auch eine eigene Gerichtsbarkeit, z.B. das Court of Chancery. Daher würde ich auch i diesem Fall eine Klammer und eine Fußnote empfehlen.

I just realised that the asker is not German. So, I suggested to leave the term and maybe to insert a footnote. Equity is a separate jurisdiction and many claims are based on equity and equitable principles, e.g. specific performance, which under German law is very basic, but under Common Law falls under equitable jurisdiction.
