German term

Einrede erheben

German to English Law/Patents Law: Contract(s)
Der AN ist nicht berechtigt, die Einrede des nicht erfüllten Vertrages zu erheben

I know the translation below wrong. How is this expressed in English (or even an explanation in German or English would help, don't really know what's being said here). Thanks!! And if "lodge a plea" is right, how do I deal with the "des"?

The Supplier is not entitled to *lodge a plea of the non-satisfied agreement.*

Peer comment(s):

agree Jane Luther : or "non-performance" (without "of the contract". There are quite a few discussions on the meaning of "Einrede" in a legal context in LEO which are quite helpful
