EU decision Even the EU decision referred to in the context uses "gleichgestellte Situation", rather than "... Tatbestand" (see English and German sources cited in my answer).

They are not in gainful employment or in any equivalent situation. "Tatbestand" is a German legal term which cannot be translated literally into English.

Where is the problem? I've searched for "Beschluss F1 vom 12.06.2009" (note that its F1 not FI), and here you go:

As pointed out, it is Tatbestand - factual *nexus* in German criminal law - and not eine gleichgestellte Situation.

It is also remiss of the writer of the 'German' - it NOT being possible to ausüben either a Situation or Tatbestand - to misquote the EU authority.

The EU doc. doesn't refer to Tatbestand, so the wording needs to be adapted.

The EU doc. doesn't refer to Tatbestand.//Not a true synonym: die Situation is a general label. Der Tatbestand has a precise legal meaning for an ingredient of a civ. or crim. offence or, as here, a wider nexus//Tatbestand could be unlawful on Ali-Platz.
